How Bail Works?
A judge sets a bail after obtaining information about the criminal charges and background of a defendant. The judge makes a decision as to what amount and type of bail is necessary to guarantee a defendant will attend future court dates.
In exchange for a non-refundable state 10% fee, plus a $37.00 state tax and fee. A Tenessee licensed mandated bail bondsman pledges a security bond (written obligation) with the Court.
The amount of money posted with the court must be the full amount of the bail set. These monies are returned to the person who deposited them at dismissal. All court costs and fines are deducted before the money is returned.
Release on Own Recognizance…This type of bail does not require any money to be posted with the court. What this means is that you may have a clean record and is in good faith with the judge that you will return to court on the court dates through sentencing or dismissal.
